General Terms and Conditions (GTC)

Scope of application
The following GTC apply to all services and deliveries performed by www.airsoftcompany.at to serve any orders placed by Buyer for private, non- commercial use only. Any modifications or additional agreements require explicit written confirmation by www.airsoftcompany.at. The same applies to the waver of requirement of written form. Seller shall accept no liability for errors, changes in price or modifications of the arrangement of  special offers, quantity discounts and sets.

Offers and the conclusion of the contract
The contract shall be concluded by confirmation of receipt of the order or by delivery of the goods.

Rights and consequences of revocation
According to the article 13 of the Austrian Civil Code (BGB, Bundesgesetzbuch) Buyer shall not be bound to any order placed via internet or any other means of indirect communication if the order is revoked  within one week after receipt of the goods. The order may be revoked in written form without stating reasons via e- mail to office@airsoftcompany.at or by a return consignment of the ordered goods. However, Seller shall be entitled to charge a handling fee of 20 Euro to reimburse expenditure. Within the stated period Buyer shall send the return consignment to

The goods shall be returned free from defects or signs of usage together with all undamaged parts of  packaging. The parcel shall be insured and delivered by the company DPD.

Excluded from return consignment are
1. any goods arranged according to Buyer´s  special requests and goods exclusively ordered by Seller for Buyer beyond stock goods,
2. any goods produced or modified according to Buyer´s special request.
3. any goods modified by Buyer
4. newspapers, journals and magazines

Refund of the purchase price
Seller shall refund the purchase price of the returned goods immediately and by no later than one week after receipt of the said goods. Thus Buyer shall communicate any required bank details early enough, at the latest when returning the goods. Seller shall not refund charges for the delivery of goods to Buyer, warranty cases, however, are excluded.
Buyer is not entitled to a refund of the total purchase price if the value of the goods is decreased by  usage that goes beyond the inspection of the goods  as possible when inspecting the goods directly at the shop before purchase, by damaging the goods or the packaging or by any other depreciation inflicted by Buyer. In this case Seller may adjust the refund to the decrease of value, however, if the value of the goods is decreased to an extend that makes it impossible for Seller to resell the goods at all or at reasonable prices, Seller is not obliged to accept or refund the revoked goods.

Prices and terms of delivery
The currency of all prices mentioned is Euro, all prices include VAT (value added tax). If possible invoices shall include separate listings of the VAT.
Seller shall deliver the goods after payment by transfer to Seller´s bank account, all necessary bank details shall be communicated to Buyer in time. All goods may also be directly bought and payed in cash at Seller´s shop during opening hours.  In case of delivery to non- EU states Buyer shall take responsibility for the correct payment of duties.
In case of delivery by the company DPD any possible damage due to transportation shall be communicated to the deliverer at the moment of receipt, if necessary, Buyer may reject the goods, indicating to the damage. If the goods get lost or damaged in the course of delivery, Seller immediately may claim refund at the responsible party or start investigations into the whereabouts of the goods. Seller is not obliged to reimburse the lost goods or to refund their purchase price until all investigations are concluded and  there is evidence that the goods  were damaged by transportation.

Warranty
All cases of warranty comply with the Austrian Civil Code, provided that Buyer used the goods according to the instruction manual and there is no evidence to  negligent or incorrect usage.
Seller shall repair or exchange any defective goods. If it is impossible to repair the goods or if the additional delivery shows the same damages, Buyer is entitled to receive the purchase price of the returned goods or to purchase the damaged goods at reduced prices, as especially agreed upon with Seller. Further information on a possible manufacturer's warranty Buyer may find in the respective product description. To claim warranty it is sufficient to provide Seller with a copy of the invoice.

Force majeure
If Seller is unable to provide ordered services or deliveries due to forces majeure (especially outbreak of war, natural catastrophes, strike), Seller shall be free from liability to provide these services and deliveries as long as Seller is affected and hindered by forces majeure.
Buyer shall have the right to revoke the contract if Seller is unable, due to forces majeure, to provide ordered services and deliveries for more than one month. No other rights shall be entitled to Buyer in this case.

Applicable law and jurisdiction
The applicable law shall be the Austrian Civil Code. The Vienna Convention of April 11, 1980 of the United Nations on The International Sale of Goods shall not be applicable. Place of performance is the residence of the company www.airsoftcompany.at.
For the conclusion of contracts with merchants, corporate bodies under public law or a seperate estate under public law the only jurisdiction competent of legal disputes arising from this business relation, including action on a bill of exchange or order for payment of a check, shall be that of Seller`s country.
